In March, Transform RSA NPC and the National Union of Metal Workers of South Africa NUMSA lodged an urgent application for an order interdicting Eskom from concluding the twenty-seven 27 renewable energy Independent Power Producer Projects IPP including the PPAs with Eskom, pending finalisation of the main application instituted under case no. 42887/2017, the Coal Transporter’s Forum matter. Energy Minister Jeff Radebe announced on Tuesday that agreements for 27 renewable-energy independent power producer IPP projects, which have been delayed since 2016, will be signed on Wednesday, April 4. The projects have a collective investment value of R55.92 -billion. The Department of Energy DoE said the agreements would include the power purchase agreements PPAs with Eskom. The department said the "milestone" had been reached following a long period of uncertainty, which arose initially after Eskom indicted in early 2016 that it was unwilling to enter into new PPAs with renewables IPPs, having returned to a surplus operating position. The uncertainty was then extended further after the...

However, the court ruled that the application was not urgent and that it should be set aside. South African Wind Energy Association SAWEA...

The excitement associated with Energy Minister Jeff Radebe’s move to end two years of confidence-sapping uncertainty in South Africa’s independent power producer IPP market, turned to frustration on Tuesday when the signing of agreements for 27 renewable-energy projects was voluntarily delayed by government following a legal challenge. The legal objection arose from an unlikely partnership between National Union of Metalworkers of South Africa Numsa and Transform RSA, which approached the court to prevent power utility Eskom from concluding power purchase agreements PPAs with the IPPs on March 13 as planned. Hitherto, Numsa and Transform RSA have been on opposing ends of the political...
